Terms and Conditions.

Please read this carefully. These are the terms and conditions under which you may use YooSing. These terms apply to your use of YooSing irrespective of the delivery platform you use - e.g. desktop PC, laptop, mobile device, PDA or otherwise - and irrespective of how YooSing content is delivered to you - e.g. via web browser, WAP browser, email, SMS or otherwise. By registering you are agreeing to the terms and conditions below. You are responsible for bringing these terms and conditions to the attention of anyone who may access the material as a result of you.

If you do not agree with the terms and conditions (or are not authorised to do so) you should not register on YooSing. If you have any questions please contact us at customerservices@yoosing.com. We recommend that you print a copy of these terms and conditions for your records.

1. Definitions.

In these Terms and Conditions, the following words and phrases shall bear the following meanings:

- 'YooSing' is a product owned and operated by Sing to the World Limited whose registered office is at Karaoke Central, Gorsey Lane, Coleshill, B46 1JU.

- 'Material' means data or information in any format, including without limitation text, images, photographs, graphics, video or sound material whether existing at the time of registration or not, published on YooSing, whether copyright of YooSing or of a third party and which is communicated or transmitted to the User in using YooSing.

- 'Personal Information' means Personal Data as defined in the Data Protection Act 1998 as amended.

- 'User' means any person who accesses or uses YooSing.

2. Introduction

By accessing or using YooSing, the user acknowledges and agrees to be bound by these Terms and Conditions.

The User agrees to fully comply with these Terms and Conditions, including the acceptance of liability as detailed in clause 5 and 7.

Each user is allocated a unique user name and password for the authorised use of the User only. These are not transferable, and the User shall keep them strictly confidential and secure. The User should notify Sing to the World immediately if any unauthorised use comes to its attention.

The User shall indemnify Sing to the World against any unauthorised use of his/her user name and password, including use by a third party where the User has allowed or facilitated that third party to have access to any material, however so received.

The User shall indemnify Sing to the World against all costs, claims, demands or expenses incurred by or made against Sing to the World or YooSing as a result of any breach of these Terms and Conditions or howsoever arising.

3. Guidelines for posting Material on YooSing.

In order to maintain a healthy and enjoyable atmosphere here at YooSing, we appreciate it if users kindly co-operate with the following guidelines. These guidelines are in place to ensure that YooSing remains a pleasant and informative site to visit, and to prevent unnecessary conflicts on the forums. Failure to comply with these rules and policies may result in your banishment from the site.

Should a user have any problems or issues regarding any subject on the forum or the acts of any other user, they should report it by clicking on the report abuse link. YooSing is not the place of users to moderate or in any way govern or judge others.

There are three main principal guidelines:

1. Be courteous and polite. Show respect to the opinions and feelings of others. Use of the forums, comments and notes is a privilege, not a right.

2. You are responsible for your own words and recordings, video and/or audio and any harm they may cause. Please think before you post content on YooSing.

3. YooSing does not support irrelevant and unnecessary content.

The owners of YooSing reserve the right to remove, edit, move or close any thread with or without reason or notice. Polite enquiries will be listened to. Any form of harassment will not be tolerated and is cause for instant banishment from the site.

By registering with YooSing, you agree to the following guidelines and policiies:

YooSing Policy.

All of the following guidelines have been formulated in the interests of maintaining a level of professionalism and respect amongst users on YooSing.

Because YooSing is a Singing related community, and in the interests of keeping potentially offensive topics away from the site, YooSing administrators do not tolerate posts that contain any of the following subjects or elements:

- Politics or political propaganda in any form

- Potentially inflammatory discussions or comments regarding social issues. These include, but are not limited to, topics such as racism, sexism, religion, xenophobia or homosexuality.

- Crude, derogatory, inappropriate, or disrespectful remarks aimed at any individual(s)

- Offensive or unnecessarily abrasive comments directed at any individual are not tolerated in any form. These include anything from personal vendettas to unnecessarily insulting comments directed at the recordings and or work of any individual. Critiques of recordings displayed should not include unnecessarily derogatory remarks (whether aimed at the user or the work itself) in any form.

- Spamming - blatant spamming will be removed.

- Hate speech - Derogatory, anti-social or inflammatory remarks aimed at any group of people, with the intention to incite a mass response are not only a crime in most countries, but are also totally unacceptable here

- Any comments made with the sole intention of disruption or to cause distress to any individual(s) whether made metaphorically, or otherwise, any personal defamatory remarkd directed at any individual(s) are unacceptable

- Nudity and Pornography - Images, animations and or video depicting blatant nudity and or pornographic acts including intercourse, masturbation, bestiality or abuse, and links to pornographic sites are not tolerated under any circumstances

- Racial Slurs

- Piracy

Users requesting or advertising warez (or links to warez sites), serial numbers, cracks, illegally copied software documentation, pirated music, links to pirated music files, are not welcome on this site. YooSing does not tolerate any members that, in any way, aid or encourage the use of illegally acquired software.

General Notes

Posts containing subject matter listed above will be removed in all cases, and should the author of such posts or material persist in posting such matter, that user will be banished from the site.

The Administrators of YooSing request that all users remain, at all times, respectful and courteous towards all other members on the site.

We believe that these guidelines are fair and acceptable, and that all users should respect our reasons for keeping them in place. The Administrators are not there to police everyone, but rather to protect users from offensive or unlawful content.

Should a user have any problems or issues regarding any subject on the forum or the acts of any other user, they are encouraged to contact the Administrators who will attend the matter.

Users are also encouraged to use the report abuse link on YooSing, should they feel that any comments or material posted by members have violated any of the guidelines stipulated here.

4. Access to YooSing

In order to submit material to YooSing the User must register as a personal user via the unique user name and password. The User undertakes not to maliciously create additional registration accounts for the purpose of abusing the functionality of the site, or other users; nor to seek to pass itself off as another user.

Sing to the World reserves the right to prohibit access by person(s) to YooSing at its sole discretion at which time the agreement will terminate.

5. Condition of Use

The submission of Material by the User is on the following terms:

1. The User grants Sing to the World a non-exclusive, non-transferable, perpetual, royalty-free, worldwide licence to publish or use the Material in any format, including in other products of Sing to the World. The licence shall include the right for any Users to take actions in accordance with clause 3.

2. The User warrants to Sing to the World that all rights including intellectual property and moral rights in the Material submitted belong to the User or the User has received all necessary permissions to submit it to Sing to the World

3. The User warrants to Sing to the World that the material submitted is not obscene, offensive, defamatory of any person or otherwise illegal.

4. Sing to the World at its sole discretion reserves the right to not publish the Material in part or whole, make additions or deletions to, edit, crop or arrange the Material prior to publication. Sing to the World may do so without giving any reason but the User should note that Material that is off-topic or unnecessarily antagonistic is likely to be rejected.

5. Sing to the World shall make no payment for Material submitted and used under these Terms and Conditions

6. Data Protection and Privacy

Sing to the World takes the privacy of its Users seriously. It is committed to safeguarding the privacy of its Users. Please refer to the PRIVACY POLICY.

7. Liability

The User acknowledges that any breach of a clause outlined in these Terms and Conditions which may cause damage or loss to Sing to the World and agrees to indemnify Sing to the World in full against any third party liabilities, claims, costs, loss or damage including consequential losses, incurred as a result of publishing Material submitted.

To the extent permitted by law Sing to the World, its agents or representatives shall have no liability whatsoever to the User for any direct, or indirect or consequential loss or special loss or damage, cost or expense suffered or incurred by the User (whether arising in tort, contract or otherwise, and whether arising from negligence, breach of contract, defamation, infringement of copyright or other intellectual rights) caused by the use of YooSing or from the negligence of its employees or agents or licensors, and whether asserted against Sing to the World or against any third party in relation to its use.

Sing to the World does not make any representation or give any warranty, either express or implied:

1. in relation to any information, goods or services offered, accessed or obtained through YooSing;

2. in relation to warrantees of title, non infringement of copyright or patent rights of others, merchantability, or fitness or suitability for any purpose;

3. for the content, accuracy, integrity, lawfulness or otherwise of information on websites over which Sing to the World has no control;

4. as to the suitability of the information and data on YooSing for any particular purpose;

5. that the information and data on YooSing site is free of infection by computer viruses or other contamination. Sing to the World and its agents or representatives do not endorse or in any respect warrant any third party products or services by virtue of any advertisement, information, material or content referred to, or included on, or linked from or to YooSing.

YooSing does not purport to provide advice. Sing to the World is not responsible for Users taking or refraining from taking actions on the basis of information provided by YooSing. Although every care is taken in the preparation of information supplied by YooSing, Sing to the World is not responsible for any loss suffered as a result of any action taken or refrained from being taken as a result of any information contained in YooSing.

8. Trade Marks And Intellectual Property

All rights in 'YooSing' and other marks owned by Sing to the World are reserved.

All Material other than submitted by Users on YooSing is property of Sing to the World. Reproduction without Sing to the World's permission is prohibited. For such permission Users should e-mail customerservices@yoosing.com

9. Miscellaneous

Sing to the World reserves the right to remove, alter, change or vary YooSing at any time without notice.

Sing to the World shall endeavour to provide constant, uninterrupted access to YooSing but do not guarantee to do so and accept no responsibility or liability for any interruption or delay.

10. Applicable Law and Jurisdiction

The provision of YooSing is governed by the laws of England and shall be subject to the jurisdiction of the English courts.

11. Variation

Sing to the World reserves the right to vary or amend these Terms and Conditions at any time without notice. Users should review these Terms and Conditions regularly as Users will be deemed to have accepted a variation in continuing to use the site after it has been posted.

Sing to the World is registered with and pays royalties to Mechanical Copyright Protection Society (MCPS).
